Hi Atty. Lerner,
My brother and I were petitioned by my parents residing in the USA in 2000. Our petition type is F2B. Our petition became current in 2009. However, I wasn’t able to process mine. I immediately wrote the NVC detailing my marital status. I would like to underscore the fact that when my parents filed our petition in 2000, I was still single. In 2003 I got married. Unfortunately, I got separated in 2006. I filed for an annulment before a Regional Trial Court in 2009 and I am expecting the dissolution of my marriage to be granted by the Court by April-May of this year. Had I remained single, I should have migrated to California with my brother last December 4, 2010. When I wrote the National Visa Center regarding my case in 2010, I was informed that my papers were sent back to the CIS. No reasons were disclosed.
In view thereof, I would like to inquire whether my petition (which became current but was returned by the NVC to the CIS as soon as I informed them about my status) could be reactivated as soon as the Court grants the dissolution of my marriage, which in effect, makes me single again. How do I go about in availing your consultation here in the Philippines so that I can be guided with my courses of action. I need to know what documents must be presented as well as the pertinent fees.
